How Is It Possible To Seal My Arrest Record In California?
People’s records can be sealed in California if they were arrested but never convicted of a crime. This means that it won’t show up on most background checks in the state.
The law has changed so that an arrest record can be hidden by law.
What Does Sealing An Arrest Record “As A Matter of Right” Mean?
Our previous California laws required that the person who was arrested had the proof that s/he was factually innocent in order to have his or her arrest record sealed.
The new law shifts the burden of proof to the prosecutor. S/he must prove that the person who was arrested is NOT entitled to have their record sealed.
Who Else Is NOT Eligible To Have An Arrest Record Sealed?
It is important to understand that not everyone’s record is eligible to be sealed in California.
You may not be eligible to have your arrest record sealed if you:
- May still be charged with any of the offenses you were arrested for
- Were arrested for murder or any other crime that does not have a statute of limitations — unless you were acquitted or found factually innocent of said charge
- Intentionally evaded prosecution of the arrest, including fleeing the jurisdiction or engaging in identity fraud
Is there a deadline for moving to seal my California arrest record?
Under prior California Penal Code 851.8 people had just two years from the later of their arrest or the filing of charges to petition to seal their arrest record. Penal Code 851.87 contains no time limit for petitioning.
However, the new law has not yet been tested in court.
Accordingly, we recommend filing a petition to seal an arrest as soon as it is no longer possible for the prosecutor to file or refile charges.
