WHAT IS CALIFORNIA ARREST RECORD SEALING?

If the charges against you were dropped by the prosecutor, if you were only detained and then released (“detention only”), or if you participated in a pre-filing diversion program instead of the prosecutor filing an accusatory pleading, the PC 1000.5 drug diversion program, or certain deferred entry of judgment programs, your arrest record may be sealed in California.

One can get an arrest record sealed in the state of California in some different ways. Two forms of relief were signed into law by Governor Jerry Brown on October 11, 2017: the first, known as a “factual innocence” sealing and codified in California Penal Code Section 851.8, and the second, known as the Consumer Arrest Record Equity (CARE) Act, which is a newer kind of relief. This final kind of relief became law on January 1, 2018, as Section 851.91 of the California Penal Code. Finally, under California Penal Code sections 851.87 and 851.90, you may be eligible if you have completed a pre-filing diversion program, the PC 1000.5 drug diversion program, or a particular deferred entry of judgment program.
The sealing of a criminal record in California is not a merit badge. Instead, it’s designed to wipe up any trace of an arrest that didn’t lead to a conviction. Without it, you may have trouble getting a job, renting an apartment, or obtaining a professional license because of an arrest you were later exonerated of or that the District Attorney (DA) decided not to prosecute you for due to a lack of evidence. People’s records can be sealed in California if they were arrested but never convicted of a crime. This means that it won’t show up on most background checks in the state. The law has changed so that an arrest record can be hidden by law.

Our previous California laws required that the person who was arrested had the proof that s/he was factually innocent in order to have his or her arrest record sealed.

The new law shifts the burden of proof to the prosecutor. S/he must prove that the person who was arrested is NOT entitled to have their record sealed.

It is important to understand that not everyone’s record is eligible to be sealed in California.

You may not be eligible to have your arrest record sealed if you:

  • May still be charged with any of the offenses you were arrested for
  • Were arrested for murder or any other crime that does not have a statute of limitations — unless you were acquitted or found factually innocent of said charge
  • Intentionally evaded prosecution of the arrest, including fleeing the jurisdiction or engaging in identity fraud
Under prior California Penal Code 851.8 people had just two years from the later of their arrest or the filing of charges to petition to seal their arrest record. Penal Code 851.87 contains no time limit for petitioning. However, the new law has not yet been tested in court. Accordingly, we recommend filing a petition to seal an arrest as soon as it is no longer possible for the prosecutor to file or refile charges.
