If the charges against you were dropped by the prosecutor, if you were only detained and then released (“detention only”), or if you participated in a pre-filing diversion program instead of the prosecutor filing an accusatory pleading, the PC 1000.5 drug diversion program, or certain deferred entry of judgment programs, your arrest record may be sealed in California.

One can get an arrest record sealed in the state of California in some different ways. Two forms of relief were signed into law by Governor Jerry Brown on October 11, 2017: the first, known as a “factual innocence” sealing and codified in California Penal Code Section 851.8, and the second, known as the Consumer Arrest Record Equity (CARE) Act, which is a newer kind of relief. This final kind of relief became law on January 1, 2018, as Section 851.91 of the California Penal Code. Finally, under California Penal Code sections 851.87 and 851.90, you may be eligible if you have completed a pre-filing diversion program, the PC 1000.5 drug diversion program, or a particular deferred entry of judgment program.
The sealing of a criminal record in California is not a merit badge. Instead, it’s designed to wipe up any trace of an arrest that didn’t lead to a conviction. Without it, you may have trouble getting a job, renting an apartment, or obtaining a professional license because of an arrest you were later exonerated of or that the District Attorney (DA) decided not to prosecute you for due to a lack of evidence. The Kareem Law APC includes a subsidiary called Lifeback Legal. We can assist you in having your arrest record sealed in the state of California. We’re here to help you find a private advocate since we know that’s what you’re looking for.

Questions To Ask When Choosing Your Criminal Defense Attorney
People’s records can be sealed in California if they were arrested but never convicted of a crime. This means that it won’t show up on most background checks in the state. The law has changed so that an arrest record can be hidden by law.

Our previous California laws required that the person who was arrested had the proof that s/he was factually innocent in order to have his or her arrest record sealed.

The new law shifts the burden of proof to the prosecutor. S/he must prove that the person who was arrested is NOT entitled to have their record sealed.

It is important to understand that not everyone’s record is eligible to be sealed in California.

You may not be eligible to have your arrest record sealed if you:

  • May still be charged with any of the offenses you were arrested for
  • Were arrested for murder or any other crime that does not have a statute of limitations — unless you were acquitted or found factually innocent of said charge
  • Intentionally evaded prosecution of the arrest, including fleeing the jurisdiction or engaging in identity fraud
Under prior California Penal Code 851.8 people had just two years from the later of their arrest or the filing of charges to petition to seal their arrest record. Penal Code 851.87 contains no time limit for petitioning. However, the new law has not yet been tested in court. Accordingly, we recommend filing a petition to seal an arrest as soon as it is no longer possible for the prosecutor to file or refile charges. An experienced California criminal lawyer can help you determine when you have eligibility to file for relief.

I was arrested and was facing 2 felonies in October and spent some time sitting in county jail. After calling tens of lawyers to help I immediately knew Kareem would provide the help I was looking for. He walked me through the entire court process and was very reassuring that I had nothing to worry about. It is a great feeling when you have a confident lawyer behind you. Kareem managed to get my case dismissed and I have no charges on my record now. I don’t think I would have this result if it weren’t for his help. I would recommend him to anyone. He knows what he’s doing and he is the man for the job.

Before hiring Kareem Law I made the mistake of listening to some ads for personal injury attorneys on the radio. I did not know what to expect since this was my first time needing to hire an attorney. The first office never returned my calls and never connected me with an attorney. I thought attorneys wanted to help their clients not treat them like dirt. I found Kareem's office after a family member told me of an attorney who did excellent work on his personal injury case. From the first call with Kareem he created a strong relationship with me where I felt appreciated and heard. Mr. Ramadan was always available when I needed answers and did a fabulous job settling my case.

His empathy and care for my situation, were encouraging and made me feel safe. Kareem was very personable, reachable, and communicated clearly. Kareem put a lot of effort to get the case dismissed and achieve a complete resolution without the additional stress of a trial. I am beyond grateful to him!

Never in my life, did I think I would need a criminal defense attorney. A close family member committed a federal crime and suddenly I was searching for a criminal defense attorney. I submitted an inquiry to all lawyers in the Upland area and I am so thankful that Attorney Kareem was quick to reply on a Sunday afternoon! The next day, he was already doing a jail visit with my family member. The following day, we were meeting and discussing the case in his office. Right from the beginning,Kareem expressed his care and compassion for us and my incarcerated family member. He also made us feel very comfortable telling us a personal story of his that made him appreciate nurses, which my mom and I are! This life journey of his, made us feel that he knows the value of life and our family member would be in excellent hands.Kareem was always available to answer all our questions. If you call him or text him, he will always respond right away or within a few hours. This was an extremely difficult time in our lives and Kareem was always there to ease our minds. When trying to find an attorney who is going to save your life or a close family members, you have to fully trust your lawyer and Kareem is that man. He strongly advocated for my family member and got him released from jail with a mental health diversion. This was the goal from the beginning and we could not be more thankful to Attorney Kareem for the outcome.
