What Is Considered Child Abuse?

Several crimes are classified as child abuse under California law. If you are accused of child abuse, it is critical that you understand the most common charges and their consequences.

The two most common child abuse charges in California are:

  • Felony: According to California penal code section 273a (a), a felony is defined as "willful cruelty or neglect with the threat of great bodily injury or death." In layman's terms, you could be charged with a felony if you willfully allowed any child to suffer physical or mental pain that could result in injury or death. You could also face felony charges if you willfully endanger a child's health or put a child in a situation where their person or health is jeopardized.

  • Misdemeanor: In California, a misdemeanor is defined as "willful neglect or cruelty not likely to result in death or significant bodily injury." In a nutshell, a misdemeanor charge is preferred when you are accused of willfully allowing any child to suffer physical or mental pain that is not likely to result in great bodily harm or death.

Remember that these laws apply to both people who have custody of a child and anyone who has no relationship with a child.

What are the Most Common Types?

California laws prohibit any type of cruelty towards a child, including physical attacks, mental abuse, neglects, sexual abuse, and more.

Child abuse laws typically cover the same counts regardless of the county in which the abuse occurred:

  • Assault: Child abuse laws prohibit physical attacks on children as well as any other action that may endanger the child. You could be charged with child abuse if you cause minor injuries like bruises or more serious injuries like broken bones, deep cuts, and burns. Prosecutors may charge you with child abuse even if you did not intend to cause the injury.

  • Discipline: Most child abuse occurs during parental discipline. California courts require parents and custodians to discipline children in their best interests. Essentially, abusive child discipline is unreasonable.

  • Sexual abuse of minors is abusive. Adults who engage in sexual activity with minors are often charged with child abuse because children cannot consent. Sexual abuse includes lying, coercion, bribery, and minor sexual demands. Rape, exhibitionism, sexual videos, games, pictures, and forced viewing of sexual acts are included. Sexual abuse does not require physical force.

  • Neglect: Accidental injuries to a child are not considered abuse, but carelessness and negligence are. Abuse occurs when children are left alone. Child abuse can also include neglecting medical, shelter, or emotional needs. Inadequate supervision, housing, food, clothing, and hygiene can also lead to trouble.

  • Emotional abuse: Verbal and emotional abuse are child abuse in California. An accused's actions or attitude can harm a child's mental health or social development. This includes name-calling, shouting or yelling at a child, making fun of, or belittling a child. You can be charged with child abuse if the child is not physically harmed. A parent who verbally abuses or humiliates a child is abusing them.

What Are the Legal Consequences?

In California, breaking the law on child abuse is typically considered a severe state matter that attracts severe consequences.

The following are some of the critical consequences of child abuse conviction:

  • Fines: If you're found guilty of abusing a child, you'll almost always have to pay a lot of money.

  • Jail or prison: People who abuse children often end up in jail or prison. In California, if you are convicted of a misdemeanor, you will spend one year in county jail. If you are convicted of a felony, you will spend six years or more in prison.

  • Probation sentences: Probation sentences often accompany child abuse sentences in California. Both misdemeanor and felony convictions attract four years of probation and one year of a child abuser's treatment and counseling program.

  • Other penalties: If a parent or guardian is convicted of child abuse, the court in Los Angeles may limit parental rights. These include restraining orders and placing a child in the care of a foster family or a state agency.

Questions To Ask When Choosing Your Criminal Defense Attorney

If you hit a child, you could be charged with a misdemeanor or a felony. The California Penal Code 273d PC says that child abuse is hurting a child physically or giving them a cruel punishment.

Child abuse is when a child is hurt or treated badly on purpose. These could include but are not limited to hurting a child physically, abusing them sexually, ignoring them, or treating them badly. Child abuse is, in a nutshell, any action that could hurt or threaten the safety or health of a child.

When someone is found guilty of abusing a child, bad things happen. Some of these are jail or prison time, fines, registration as a child offender, restraining orders, loss of custody or parental rights, and registration as a child offender. It could also mean that the person’s probation or parole is limited or that they are sent to a mental hospital against their will.

Section 288 of the California Penal Code says that abusing a child is a felony that can get you up to 8 years in jail. The law protects children who are especially vulnerable, but it also protects parents, caregivers, and others who work with children. Most of the time, accusations of child abuse are based on false accusations or misunderstandings. If you are facing a child abuse charge in Los Angeles, the best thing you can do is find a qualified and experienced lawyer to help you. A lawyer will tell you about your legal rights and choices.

I was arrested and was facing 2 felonies in October and spent some time sitting in county jail. After calling tens of lawyers to help I immediately knew Kareem would provide the help I was looking for. He walked me through the entire court process and was very reassuring that I had nothing to worry about. It is a great feeling when you have a confident lawyer behind you. Kareem managed to get my case dismissed and I have no charges on my record now. I don’t think I would have this result if it weren’t for his help. I would recommend him to anyone. He knows what he’s doing and he is the man for the job.

Before hiring Kareem Law I made the mistake of listening to some ads for personal injury attorneys on the radio. I did not know what to expect since this was my first time needing to hire an attorney. The first office never returned my calls and never connected me with an attorney. I thought attorneys wanted to help their clients not treat them like dirt. I found Kareem's office after a family member told me of an attorney who did excellent work on his personal injury case. From the first call with Kareem he created a strong relationship with me where I felt appreciated and heard. Mr. Ramadan was always available when I needed answers and did a fabulous job settling my case.

Never in my life, did I think I would need a criminal defense attorney. A close family member committed a federal crime and suddenly I was searching for a criminal defense attorney. I submitted an inquiry to all lawyers in the Upland area and I am so thankful that Attorney Kareem was quick to reply on a Sunday afternoon! The next day, he was already doing a jail visit with my family member. The following day, we were meeting and discussing the case in his office. Right from the beginning,Kareem expressed his care and compassion for us and my incarcerated family member. He also made us feel very comfortable telling us a personal story of his that made him appreciate nurses, which my mom and I are! This life journey of his, made us feel that he knows the value of life and our family member would be in excellent hands.Kareem was always available to answer all our questions. If you call him or text him, he will always respond right away or within a few hours. This was an extremely difficult time in our lives and Kareem was always there to ease our minds. When trying to find an attorney who is going to save your life or a close family members, you have to fully trust your lawyer and Kareem is that man. He strongly advocated for my family member and got him released from jail with a mental health diversion. This was the goal from the beginning and we could not be more thankful to Attorney Kareem for the outcome.
