What Is Considered Child Abuse?

The two most common child abuse charges in California are:

  • Felony: According to California penal code section 273a (a), a felony is defined as "willful cruelty or neglect with the threat of great bodily injury or death." Remember that these laws apply to both people who have custody of a child and anyone who has no relationship with a child.

What are the Most Common Types?

California laws prohibit any type of cruelty towards a child, including physical attacks, mental abuse, neglects, sexual abuse, and more.

Child abuse laws typically cover the same counts regardless of the county in which the abuse occurred:

  • Assault: Child abuse laws prohibit physical attacks on children as well as any other action that may endanger the child. You could be charged with child abuse if you cause minor injuries like bruises or more serious injuries like broken bones, deep cuts, and burns. Prosecutors may charge you with child abuse even if you did not intend to cause the injury.

  • Discipline: Most child abuse occurs during parental discipline. California courts require parents and custodians to discipline children in their best interests. Essentially, abusive child discipline is unreasonable.

  • Sexual abuse of minors is abusive. Adults who engage in sexual activity with minors are often charged with child abuse because children cannot consent. Sexual abuse includes lying, coercion, bribery, and minor sexual demands. Rape, exhibitionism, sexual videos, games, pictures, and forced viewing of sexual acts are included. Sexual abuse does not require physical force.

  • Neglect: Accidental injuries to a child are not considered abuse, but carelessness and negligence are. Abuse occurs when children are left alone. Child abuse can also include neglecting medical, shelter, or emotional needs. Inadequate supervision, housing, food, clothing, and hygiene can also lead to trouble.

  • Emotional abuse: Verbal and emotional abuse are child abuse in California. An accused's actions or attitude can harm a child's mental health or social development. This includes name-calling, shouting or yelling at a child, making fun of, or belittling a child. You can be charged with child abuse if the child is not physically harmed. A parent who verbally abuses or humiliates a child is abusing them.

What Are the Legal Consequences?

In California, breaking the law on child abuse is typically considered a severe state matter that attracts severe consequences.

The following are some of the critical consequences of child abuse conviction:

  • Fines: If you're found guilty of abusing a child, you'll almost always have to pay a lot of money.

  • Jail or prison: People who abuse children often end up in jail or prison. In California, if you are convicted of a misdemeanor, you will spend one year in county jail. If you are convicted of a felony, you will spend six years or more in prison.

  • Probation sentences: Probation sentences often accompany child abuse sentences in California. Both misdemeanor and felony convictions attract four years of probation and one year of a child abuser's treatment and counseling program.

  • Other penalties: If a parent or guardian is convicted of child abuse, the court in Los Angeles may limit parental rights. These include restraining orders and placing a child in the care of a foster family or a state agency.
