A person is charged and accused of robbery under 720 ILCS 5/18-1 when he takes the property of another by force. Robbery is a Class 2 felony punishable by 3 to 7 years in prison. If a robbery is committed near a school or a place of worship or against a disabled or elderly person, the charges can be upgraded to Class 1 felonies (i.e., those over 60 years old). Frequently, robbery cases require an eyewitness to identify the thief. The individual who was robbed or a witness to the alleged robbery must identify the suspect as the perpetrator. Increasingly, studies and research demonstrate the unreliability of eyewitness testimony. Factors that influence and affect a person’s memory include:

AGGRAVATED ROBBERY
A person is charged with aggravated robbery under 720 ILCS 5/18-5 when he unlawfully takes another person’s property with the actual or perceived threat of a weapon or firearm. A person may be charged with aggravated robbery if they employ physical force during a robbery. The offense of aggravated robbery is more serious than that of simple robbery. The penalties and fines are increased, and the law will be enforced more strictly. Classified as a felony of the first degree, aggravated robbery is punishable by between 4 and 15 years in prison by the California Department of Corrections. The offense of aggravated robbery is not probational.
ARMED ROBBERY –
A person can be charged with armed Robbery under 720 ILCS 5/18-2 if he uses a dangerous weapon to unlawfully take the property of another. Armed Robbery is a Class X felony that carries a minimum of six years and a maximum of thirty years in the California Department of Corrections. If a firearm is used, 15 years will be added to the class X sentence of 6-30 years, bringing the total range to 21-45 years. If a firearm is discharged during the commission of an armed robbery, a 25-year enhancement is added to the 6-to-30-year class X sentence, bringing the total to 31-to-55 years in prison. Armed Robbery can also be committed with a weapon other than a firearm. Armed Robbery can be committed with axes, hatchets, brass knuckles, billy clubs, baseball bats, knives, or any other “dangerous” weapon.
There are several different ways you may be charged with robbery under Section 211 of the California Penal Code. Robbery cases belong to the range of property crimes that include shoplifting, theft, and burglary.
A conviction for these property crimes will likely lead to time behind bars. Robbery law is divided into first-degree and second-degree crimes. The number of prior convictions under Health and Safety Code section 11357.
To be convicted of robbery, the prosecutor must prove all elements of the crime beyond a reasonable doubt. It’s important to know that robbery is a felony, and prosecutors will seek prison time.
The legal penalties will vary according to whether it is first or second-degree robbery:
Sentences for first-degree robbery include a maximum criminal penalty of up to nine years of jail time and a fine of up to $10,000, as well as sentencing enhancements for actions such as bodily injury and gun use.
Second-degree robbery penalties include a $10,000 fine, up to 5 years in state prison, and enhanced penalties.
An experienced attorney will be skilled in defense strategies against all types of charges, including the California Three Strikes Law, under which defendants receive a prison sentence of between 25 years to life if they have two or more prior convictions for a violent or serious felony.
