California Robbery Defense Lawyer

A person is charged and accused of robbery under 720 ILCS 5/18-1 when he takes the property of another by force. Robbery is a Class 2 felony punishable by 3 to 7 years in prison. If a robbery is committed near a school or a place of worship or against a disabled or elderly person, the charges can be upgraded to Class 1 felonies (i.e., those over 60 years old). Frequently, robbery cases require an eyewitness to identify the thief. The individual who was robbed or a witness to the alleged robbery must identify the suspect as the perpetrator. Increasingly, studies and research demonstrate the unreliability of eyewitness testimony. Factors that influence and affect a person’s memory include:

A skilled, seasoned, and aggressive criminal defense attorney can expose these flaws in prosecution witnesses to demonstrate that their identification of the suspect is not credible or reliable. The credibility of an eyewitness and his ability to expose his flawed perception and memory of the events can be the difference between a prison sentence and acquittal.

AGGRAVATED ROBBERY

A person is charged with aggravated robbery under 720 ILCS 5/18-5 when he unlawfully takes another person’s property with the actual or perceived threat of a weapon or firearm. A person may be charged with aggravated robbery if they employ physical force during a robbery. The offense of aggravated robbery is more serious than that of simple robbery. The penalties and fines are increased, and the law will be enforced more strictly. Classified as a felony of the first degree, aggravated robbery is punishable by between 4 and 15 years in prison by the California Department of Corrections. The offense of aggravated robbery is not probational.

ARMED ROBBERY

A person can be charged with armed Robbery under 720 ILCS 5/18-2 if he uses a dangerous weapon to unlawfully take the property of another. Armed Robbery is a Class X felony that carries a minimum of six years and a maximum of thirty years in the California Department of Corrections. If a firearm is used, 15 years will be added to the class X sentence of 6-30 years, bringing the total range to 21-45 years. If a firearm is discharged during the commission of an armed robbery, a 25-year enhancement is added to the 6-to-30-year class X sentence, bringing the total to 31-to-55 years in prison. Armed Robbery can also be committed with a weapon other than a firearm. Armed Robbery can be committed with axes, hatchets, brass knuckles, billy clubs, baseball bats, knives, or any other “dangerous” weapon.

Why Burglary and Robbery are Different?

There are several different ways you may be charged with robbery under Section 211 of the California Penal Code. Robbery cases belong to the range of property crimes that include shoplifting, theft, and burglary.

A conviction for these property crimes will likely lead to time behind bars. A burglary attorney will have extensive knowledge of all property-related crimes as well as robbery case law and be skilled at constructing a defense against the charge of unlawfully entering into a residence or business to steal property.

What are the Different Types of Robbery in California

Robbery law is divided into first-degree and second-degree crimes. First-degree robbery occurs in an inhabited dwelling, a trailer, a vessel, or against the driver or passenger of a vehicle, such as a car, bus, taxi, or any form of transportation. A robbery that occurs while or after the victim uses an ATM is also a first-degree robbery.

Any robbery that does not involve these elements is a second-degree robbery.

  1. The amount of marijuana possessed.

  2. The age of the person ticketed.

  3. The number of prior convictions under Health and Safety Code section 11357.

What are the Penalties for Penal Code 211 PC?

To be convicted of robbery, the prosecutor must prove all elements of the crime beyond a reasonable doubt. It’s important to know that robbery is a felony, and prosecutors will seek prison time.

The legal penalties will vary according to whether it is first or second-degree robbery:

  • Sentences for first-degree robbery include a maximum criminal penalty of up to nine years of jail time and a fine of up to $10,000, as well as sentencing enhancements for actions such as bodily injury and gun use.

  • Second-degree robbery penalties include a $10,000 fine, up to 5 years in state prison, and enhanced penalties.

An experienced attorney will be skilled in defense strategies against all types of charges, including the California Three Strikes Law, under which defendants receive a prison sentence of between 25 years to life if they have two or more prior convictions for a violent or serious felony.

A criminal defense lawyer will also be skilled in defending against charges made under Penal Code 12022.53 PC, known as the “10-20-Life: Use a Gun and You’re Done” law, which enhances the penalties in cases in which the suspect used a gun.

A charge of attempted robbery is possible where all the elements of robbery are not fulfilled. In such cases, the prosecution must prove that the suspect intended to commit a crime and that they took a direct step to commit it. Penalties include half of the state or county jail sentence and half the maximum fine of up to $5000.

How to Defend Against Robbery Charges in Los Angeles

If you are under investigation or charged with robbery, you are advised to remain silent and refuse to answer any questions until you have spoken with a criminal defense lawyer. You have the right to advice from an attorney proficient in defense strategies.

A robbery lawyer experienced in crimes such as robbery and connected felonies such as receipt of stolen property will carefully review your case. As prosecutors consider how a robbery was carried out, a robbery attorney will look for factors that may reduce the charges, such as the lack of force or fear in the committal of the felony, mistaken false identity, or false accusation.

An experienced lawyer will also look for errors that may have been committed by law enforcement, such as unconstitutional search and seizure. This could occur in the instance, for example, of police confiscation of evidence from your home using a search warrant issued without probable cause or even the suppression of evidence by law enforcement.

Robbery Defense Lawyer

In California, robbery is prosecuted with extreme severity. This is due to the fact that, unlike burglary and theft, robbery involves a level of threat to a person, the use of a weapon, or an injury sustained during the commission of the crime. Due to these factors, the penalties for robbery are severe and can alter a person’s life for years, decades, or even a lifetime. There are several ways to be charged with robbery, and because all robbery charges are felonies, they all carry lengthy prison terms and hefty fines. Questions To Ask When Choosing Your Criminal Defense Attorney

Try to remain calm, assess the situation, and do exactly as the offender says. Remember, the number one priority is your safety and the safety of other employees and customers. Activate alarm devices as soon as possible, but only if it is safe to do so.

Robbery is a Felony punished in the First and Second Degrees. If convicted of First Degree Robbery, you face up to nine years in state prison. If convicted of the second-degree form, you can serve up to five years in a state prison. You also face fines of up to $10,000 or fines and a prison sentence with both forms.

These include interviewing the victim, the preliminary investigator, the arresting officer, and witnesses; interrogating the suspect; examining the scene of the crime; linking the suspect with the crime; recovering the property; coordinating police activities; and preparing the supplemental case report.

I was arrested and was facing 2 felonies in October and spent some time sitting in county jail. After calling tens of lawyers to help I immediately knew Kareem would provide the help I was looking for. He walked me through the entire court process and was very reassuring that I had nothing to worry about. It is a great feeling when you have a confident lawyer behind you. Kareem managed to get my case dismissed and I have no charges on my record now. I don’t think I would have this result if it weren’t for his help. I would recommend him to anyone. He knows what he’s doing and he is the man for the job.

Before hiring Kareem Law I made the mistake of listening to some ads for personal injury attorneys on the radio. I did not know what to expect since this was my first time needing to hire an attorney. The first office never returned my calls and never connected me with an attorney. I thought attorneys wanted to help their clients not treat them like dirt. I found Kareem's office after a family member told me of an attorney who did excellent work on his personal injury case. From the first call with Kareem he created a strong relationship with me where I felt appreciated and heard. Mr. Ramadan was always available when I needed answers and did a fabulous job settling my case.

Never in my life, did I think I would need a criminal defense attorney. A close family member committed a federal crime and suddenly I was searching for a criminal defense attorney. I submitted an inquiry to all lawyers in the Upland area and I am so thankful that Attorney Kareem was quick to reply on a Sunday afternoon! The next day, he was already doing a jail visit with my family member. The following day, we were meeting and discussing the case in his office. Right from the beginning,Kareem expressed his care and compassion for us and my incarcerated family member. He also made us feel very comfortable telling us a personal story of his that made him appreciate nurses, which my mom and I are! This life journey of his, made us feel that he knows the value of life and our family member would be in excellent hands.Kareem was always available to answer all our questions. If you call him or text him, he will always respond right away or within a few hours. This was an extremely difficult time in our lives and Kareem was always there to ease our minds. When trying to find an attorney who is going to save your life or a close family members, you have to fully trust your lawyer and Kareem is that man. He strongly advocated for my family member and got him released from jail with a mental health diversion. This was the goal from the beginning and we could not be more thankful to Attorney Kareem for the outcome.
