If you have been charged with a felony in California, you face a minimum of one year in prison and potentially tens of thousands of dollars in fines. Other severe consequences of felony convictions include a permanent criminal record that, in most cases, cannot be expunged and will follow you for the rest of your life. You may be required to submit your DNA to the state of California, pay hefty fines, and forfeit your constitutional rights to vote and bear arms. In some instances, you may be required to inform your neighbors of your felony conviction, you may lose employment opportunities, and there is the social stigma associated with being a “convicted felon.” Choosing the right felony attorney is, therefore, crucial. Your future depends on it.

How Does California’s Three Strikes Sentencing Law Affect Those Charged With A Felony?

If you are charged with a new felony and have already been convicted of a strike felony, the District Attorney is obligated to file the previous strike offense as what is known as a Prior Enhancement in any new case that is filed against you.

California’s Three Strikes Sentencing Law was designed to require a person who is convicted of any new felony — after already carrying a prior serious felony conviction on their record — to be sentenced to state prison for twice as long as the sentence would have initially permitted.

If you are convicted of a serious or violent felony with two or more prior strikes, you will become eligible for a 25 years-to-life sentence as a third strike offender.

This is why it is incredibly important to retain an experienced felony defense attorney to ensure your rights are protected and that you do not fall prey to the prosecutor’s overzealous charges.

What is Considered a Felony?

The penal code, or the vehicle code, gives us directions on a felony or misdemeanor. However, the district attorney within those confines of the penal code or vehicle code ultimately has discretion on how to file the case.

In reviewing the case, the district attorney’s office is going to look for several things, including:

  • How offensive is the behavior?

  • How violent is the crime?

  • How egregious is the conduct of the person being charged?

What is the Difference Between a Felony and a Misdemeanor?

A felony charge carries more jail time — that is the big difference between a felony charge and a misdemeanor charge.

In addition, a felony charge means longer probationary periods and formal probationary periods where:

  • You have search and seizure terms.

  • And where law enforcement can come and search you without probable cause or warrant.

They can also prohibit you from spending time with other people. On the other hand, with a misdemeanor, the most jail time you will face is likely up to a year in county jail.

What is California's Three Strikes Rule?

California’s Three Strikes Rule states that each subsequent offense adds the possibility of a harsher sentence and longer prison time. However, there are statutes of limitations on all cases.

This is the time limit for the prosecution to bring a case against you. The limitations are different for each circumstance, and there are exceptions. Hiring a dedicated criminal defense attorney is always in your best interest.

We know the laws and have helped numerous clients throughout our nearly 20 years in practice. While we know that each case is different and every situation has unique circumstances, our experience can benefit you before and during the trial.

What are the Collateral Consequences of a Felony Conviction?

Being convicted as a felon comes with some serious penalties. Prison times and fines are just the beginning—there are many other ways a conviction can follow you for life. That is why when our firm takes a case, we do everything possible to defend our clients against these charges.

A felony conviction can seriously impact your future, including:

  • Disqualification for certain jobs and difficulty finding employment.

  • Loss of your right to vote or legally own a firearm.

  • Permanent loss of reputation and relationships.

  • Difficulty finding housing.

  • Disqualification for certain government benefits.

  • Ineligibility for federal student loans, grants, and professional licenses.

A Knowledgeable Felony Defense Lawyer

Some individuals charged with felonies may be eligible for probation if properly represented and presented to the court or prosecutor, but even probation carries lifelong consequences. Due to their criminal history or the nature of the charges, some individuals are ineligible for probation and are facing lengthy prison terms in the California Department of Corrections. Whether a defendant receives probation, a dismissal, or a prison sentence is heavily dependent on the skill and ability of his or her criminal defense attorney.

Questions To Ask When Choosing Your Criminal Defense Attorney
A felony will stay on your record forever in California unless you choose to take action and get the conviction removed. This is called the “expungement process” and generally requires the help of a legal representative to get underway. Rather than the federal courts, state courts handle the expungement process.

A typical timeframe to complete the expungement of a felony in California is about 4-5 months. Cases are heard by the courts in the order in which they were filed. File the forms at the court in the county where you were convicted.

However, under certain circumstances, a convicted defendant can avoid jail time. Being placed on probation or in a diversionary program can help first-time felony offenders avoid jail time. It can be essential to hire a Riverside criminal defense attorney to help guide you to get the best possible outcome.

I was arrested and was facing 2 felonies in October and spent some time sitting in county jail. After calling tens of lawyers to help I immediately knew Kareem would provide the help I was looking for. He walked me through the entire court process and was very reassuring that I had nothing to worry about. It is a great feeling when you have a confident lawyer behind you. Kareem managed to get my case dismissed and I have no charges on my record now. I don’t think I would have this result if it weren’t for his help. I would recommend him to anyone. He knows what he’s doing and he is the man for the job.

Before hiring Kareem Law I made the mistake of listening to some ads for personal injury attorneys on the radio. I did not know what to expect since this was my first time needing to hire an attorney. The first office never returned my calls and never connected me with an attorney. I thought attorneys wanted to help their clients not treat them like dirt. I found Kareem's office after a family member told me of an attorney who did excellent work on his personal injury case. From the first call with Kareem he created a strong relationship with me where I felt appreciated and heard. Mr. Ramadan was always available when I needed answers and did a fabulous job settling my case.

Never in my life, did I think I would need a criminal defense attorney. A close family member committed a federal crime and suddenly I was searching for a criminal defense attorney. I submitted an inquiry to all lawyers in the Upland area and I am so thankful that Attorney Kareem was quick to reply on a Sunday afternoon! The next day, he was already doing a jail visit with my family member. The following day, we were meeting and discussing the case in his office. Right from the beginning,Kareem expressed his care and compassion for us and my incarcerated family member. He also made us feel very comfortable telling us a personal story of his that made him appreciate nurses, which my mom and I are! This life journey of his, made us feel that he knows the value of life and our family member would be in excellent hands.Kareem was always available to answer all our questions. If you call him or text him, he will always respond right away or within a few hours. This was an extremely difficult time in our lives and Kareem was always there to ease our minds. When trying to find an attorney who is going to save your life or a close family members, you have to fully trust your lawyer and Kareem is that man. He strongly advocated for my family member and got him released from jail with a mental health diversion. This was the goal from the beginning and we could not be more thankful to Attorney Kareem for the outcome.
