Drug Recognition Expert Procedures in Los Angeles

The Drug Recognition Expert (DRE) program was developed by the Los Angeles Police Department. The purpose is threefold, to train selected DRE officers to:

  • Determine whether the individual is under the influence.

  • Evaluate the type of drug causing the impairment.

  • Rule out conditions that could contribute to the impairment.

Factors Causing DUI Charges

Alcohol and drugs impair your ability to operate a vehicle safely. Driving while impaired (DWI) differs from driving under the influence (DUI) because the blood alcohol content (BAC) requirement is below .08, whereas a DUI involves a BAC of .08 or above.   • Police or other law enforcement agents stopped them without probable cause – and they subsequently tested with a blood alcohol content above .08 percent.

  • They set out with a plan to get a ride home from a friend or take an Uber if they drank alcohol. But they forgot about that plan and did not believe they were under the influence after a few drinks. With increased vigilance by police officers and fewer “bad drivers” on the road, their driving somehow caught the attention of a law enforcement agent. They must focus on defending their driving privileges and clean record.

After being arrested for suspicion of driving under the influence (DUI) in California, the California Department of Motor Vehicles will automatically suspend your driver’s license (DMV). This suspension will not take effect instantly. After your arrest, you have 10 days to request a DMV hearing.
